Terms of Service
1. Terms and Definitions
1.1. Seller – Sole Proprietor V. I. Mikhirov
1.2. Buyer – any legally capable individual who receives information from the Seller, places an order, and purchases goods from the Seller on the website www.home-me.ua for personal use unrelated to business activities.
1.3. Product – home textile goods and related items available on the online store website www.home-me.ua.
1.4. Online Store – the Seller's website located at www.home-me.ua, created for the purpose of remote retail sales.
2. General Provisions
2.1. This document constitutes the Seller's official public offer to enter into a Product Purchase Agreement with any Buyer under the terms set forth herein.
2.2. The agreement is concluded through acceptance — by the Buyer clicking the "Place Order" button on the checkout page.
2.3. All terms are equal for all Buyers in accordance with Article 633 of the Civil Code of Ukraine.
2.4. The Seller reserves the right to amend this offer without prior notice. Amendments take effect upon publication on the website.
3. Subject of the Agreement
3.1. The Seller agrees to deliver, and the Buyer agrees to pay for and accept, the Product under the terms set forth in this agreement.
4. Order Placement
4.1. Orders are placed independently by the Buyer on the website.
4.2. Upon placing an order, the Buyer receives a confirmation email.
4.3. The Buyer consents to the processing of their personal data in accordance with the Law of Ukraine "On the Protection of Personal Data."
4.4. The Seller reserves the right to cancel an order at the confirmation stage.
4.5. All information provided by the Buyer must be accurate. In the event of errors in the provided details, the Seller shall not be held liable for failure to fulfill the order.
5. Product Pricing and Delivery
5.1. Prices on the website are listed in Ukrainian hryvnias and are valid at the time the order is placed.
5.2. Delivery is carried out by courier services at the carrier's applicable rates.
5.3. Payment is processed in accordance with the options available on the website.
5.4. Ownership of the Product transfers to the Buyer at the moment the Product is handed over to the carrier.
5.5. International shipments do not include customs duties or taxes applicable in the recipient's country.
6. Rights and Obligations of the Parties
6.1. The Seller is obligated to:
— deliver the Product in accordance with the terms of the agreement; — maintain the confidentiality of the Buyer's personal data.
6.2. The Seller reserves the right to:
— modify the terms of the offer and pricing without prior notice; — cancel an order in the event of a breach of terms by the Buyer.
6.3. The Buyer is obligated to:
— review the terms of the agreement prior to placing an order; — provide complete and accurate information for the fulfillment of the order.
7. Returns and Exchanges
7.1. In accordance with the Law of Ukraine "On Consumer Protection," bed linen is not subject to return or exchange unless it contains a manufacturing defect.
7.2. Prior to dispatch, we thoroughly inspect every order for compliance and the absence of defects.
7.3. The Buyer is required to carefully inspect the product upon receipt — paying particular attention to the packaging, completeness, and external condition of the item.
7.4. If the Buyer identifies any damage or discrepancy, the Seller must be notified immediately at the time of receipt. Only under such conditions will the Seller be able to promptly resolve the matter in the Buyer's favor.
7.5. In the event of a confirmed manufacturing defect, the Seller will arrange an exchange or issue a refund within 5 (five) business days from the date the returned product is received.
8. Liability of the Parties
8.1. Both the Seller and the Buyer shall be liable for the fulfillment of their respective obligations in accordance with the applicable legislation of Ukraine and the provisions of this agreement.
8.2. The parties shall be released from liability for partial or complete failure to fulfill their obligations under the agreement in the event of force majeure circumstances (war, states of emergency, transportation blockages, actions of government authorities, natural disasters, etc.) arising after the conclusion of the agreement and beyond the control of either party.
8.3. The party unable to fulfill its obligations due to force majeure is required to notify the other party within 3 (three) calendar days of the occurrence of such circumstances.
9. Confidentiality and Personal Data Protection
9.1. By placing an order on the website, the Buyer voluntarily consents to the processing of their personal data by the Seller in accordance with the Law of Ukraine "On the Protection of Personal Data."
9.2. The Seller undertakes not to transfer the Buyer's personal data to third parties, except as required by applicable Ukrainian law or as necessary for order fulfillment (e.g., to courier services).
9.3. The Buyer is responsible for keeping their personal data up to date. The Seller shall not be held liable for improper fulfillment of obligations resulting from the Buyer providing incorrect or outdated information.
10. Miscellaneous
10.1. This agreement is concluded on the territory of Ukraine and is governed by the applicable legislation of Ukraine.
10.2. All disputes and disagreements that may arise in the course of performing this agreement shall be resolved through negotiation. If no agreement can be reached, the dispute shall be referred to the courts in accordance with the legislation of Ukraine.
10.3. The invalidity of any individual provision of this offer shall not affect the validity of its remaining provisions.
